In this virtual discussion group, we discuss the recent changes introduced under the Environment Protection Amendment Act 2018 (Vic) (Act).

From 1 July 2021, the changes will provide the Environmental Protection Authority (EPA) and Council with greater compliance powers and obligations.

At the heart of the new scheme is the proposed general environmental duty. This will require all individuals and businesses to take proactive steps to minimise (by elimination or reduction) the risk of their activities that could potentially harm the environment or human health through pollution or waste.

Other important changes introduced under the Act that will likely impact Council include:

  • Septic tank systems and new provisions and enforcement tools;
  • Increased penalties, and new provisions and offences to enforce illegal littering;
  • The process for requesting and conducting environmental audits; and
  • New provisions to monitor noise pollution and sound.
